Lindsey Davis readily advises and assists employers from a variety of industries on a broad range of labor and employment issues. Lindsey’s practice includes:

  • Employment law counseling and regulatory compliance
  • Leave and accommodation law counseling, including the overlap and interplay between FMLA and state and federal disability law
  • Internal investigations of employee misconduct
  • Strategic defense of labor and employment disputes

Lindsey also guides educational institutions on a full range of legal and regulatory issues, including compliance with various federal and state laws, policy and procedure reviews, student conduct issues and strategic defense of discrimination claims.

Equally adept at navigating complex litigation and providing timely day-to-day counseling on operational issues, Lindsey provides comprehensive advocacy of clients' interests and practical, front-end solutions to their unique needs. She anticipates the possible impacts of new laws and regulations on client businesses as well as the application of existing laws and regulations to ever-changing and complex operational circumstances. 

Lindsey is a frequent speaker on employment and education law issues and is the Wisconsin office chair of the Labor & Employment Group.

Experience in Action

  • Providing guidance to employers of all sizes on a full range of issues involving employees, including state and federal discrimination law, reductions in force, furloughs and layoffs, family and medical leave, ADA accommodations, policies, procedures and training, and employment issues related to COVID-19.
  • Representing employers in state and federal court as well as before various administrative agencies, including the Equal Employment Opportunity Commission (EEOC), Department of Labor, National Labor Relations Board (NLRB) and Wisconsin Equal Rights and Worker's Compensation Divisions.
  • Helping educational institutions navigate compliance with various federal and state laws, including Title IX, the Family Educational Rights and Privacy Act, the Americans with Disabilities Act and Section 504 of the Rehabilitation Act.
  • Representing educational institutions in state and federal court as well as before various administrative agencies, including the U.S. Department of Education Office of Civil Rights.
  • Providing customized, front-line training to employers and educational institutions, and their supervisors, managers and human resources personnel.

Successes

  • Represented employer in a case in which the Wisconsin Supreme Court ultimately held that the employer acted lawfully when it rescinded a job offer after learning of the applicant’s numerous convictions for violence in a domestic setting. The Wisconsin Supreme Court decision established that convictions for domestic violence are to be treated no differently under the “substantial relationship” test in state law than convictions for violence in any other setting.
  • Successfully defended educational institution in a federal court case in which former student and employee alleged Title IX and Title VII sexual harassment and sex discrimination. Following extensive written and oral discovery, filed a dispositive motion and obtained summary judgment in the educational institution’s favor on all claims.
  • Navigated clients through countless complex accommodation, leave, disciplinary and termination decisions.
