Daniel Peabody is an experienced litigator who helps clients with issues involving probate litigation, commercial litigation and labor and employment matters. In particular, he has successfully represented individuals and businesses in various litigation matters. Daniel focuses on:

  • Preventing and defending against discrimination, retaliation, harassment, wrongful termination and wage and hour audits

Experience in Action

  • Representing businesses in corporate and commercial disputes, including contract disputes, commercial torts, nonsolicitation and noncompete agreements, and commercial landlord disputes.
  • Representing fiduciaries and interested parties in trust and probate litigation, including representing beneficiaries in matters removing trustees, defending claims for breach of fiduciary duty and representing conservators and guardians.
  • Representing and advising clients in intra-industry disputes and employment matters, including actions involving employee forgivable loans or notes, enforcement or defense of nonsolicitation or confidential and proprietary agreements, and the like.
  • Assists employers with drafting employment agreements; employee handbooks; nonsolicitation, noncompete and nondisclosure agreements; independent contractor agreements; and other employer/employee-related documents.

Successes

  • Obtained summary judgment in favor of a beneficiary of valuable land trust who sought removal of several co-trustees; obtained a six-figure award for attorneys’ fees and successfully defended the matter on appeal.
  • Defended a million-dollar default judgment through a motion to set aside and successfully defended the appeal.
  • Obtained summary judgment in favor of a commercial landlord against contract claims and commercial torts.
  • Obtained summary judgment in favor of a popular music group on trademark claims.
