Brittany Ogden is an experienced litigator and trial lawyer representing clients in state and federal courts across the country. She represents financial institutions and other secured creditors, servicers, trade creditors, equipment and leasing companies, agricultural entities and manufacturers in:

Brittany develops innovative legal strategies that allow her clients to achieve practical, cost-effective business objectives in even the most financially distressed situations. She is national co-chair of the firm’s Bankruptcy, Restructuring, & Creditor’s Rights Practice Group.
Experience in Action
- Representing clients in complex commercial litigation in jury and bench trials throughout the country involving tortious interference claims, lender liability allegations, breach of contract disputes and fraud and misrepresentation claims.
- Representing clients in bankruptcy and insolvency proceedings, including contested matters and adversary proceedings, contested Chapter 11 plan confirmation, use of cash collateral, claims litigation, fee disputes, preference avoidance, fraudulent transfer actions, non-dischargeability and issues arising in "free and clear" sales under the bankruptcy code.
- Representing creditors and businesses with enforcement and recovery of collateral and judgments in jurisdictions throughout the country.
- Representing clients in foreclosures and all aspects of bankruptcy proceedings, receiverships and workouts.
- Serving as lead attorney in hundreds of contested, evidentiary hearings.
- Representing financial institutions and businesses in various contested bankruptcy cases, including alleged automatic stay violations, preference actions and discharge violations.
- Addressing the needs of agricultural lenders, cooperatives and credit facilities in Chapter 12 cases, workouts, foreclosures and sale matters.
- Representing equipment leasing companies’ interests in enforcement proceedings and bankruptcy cases, addressing assumption/rejection issues and lease recharacterization claims.
- Advising manufacturers on commercial litigation and bankruptcy issues.
Successes
- Obtained a full dismissal of lender liability claims alleged against a financial institution with multi-million-dollar judgment and foreclosure awarded to client.
- Obtained full dismissal of FDCPA action against a loan servicer in federal district court.
- Obtains foreclosure judgments for clients while managing various defenses raised by defendants.
- Obtains judgments for lenders and business owners concerning civil theft, conversion and fraud claims.
