Sarah Belger Authors Law360 Article About Maryland’s New Wage Transparency Law
Sarah Belger, a partner in the Quarles & Brady Labor & Employment Group, wrote a Law360 article discussing Maryland’s new wage transparency law, which took effect October 1. The law requires employers to post salary ranges, benefit and compensation details for all part-time and full-time positions. In addition, employers must maintain compliance records for each job for at least three years, update HR policies and ensure third-party recruiters follow these rules to avoid penalties.

In addition to disclosing the pay range, employers also must post a general description of benefits and any other compensation elements offered for the position. Examples include: (1) employer-provided insurance; (2) paid and unpaid time off such as sick and vacation leave and leaves of absence; (3) retirement or savings funds such as 401(k) plans or employer-funded pension plans; and (4) other forms of compensation such as the value of employer-provided meals or lodging.

Employers are also prohibited from refusing to interview, hire, or employ an applicant who does not provide their wage history or who requests the wage range for a position from the employer. Current employees applying for a job internally are afforded the same protections.
