On January 23, 2019, a New York appellate court held that there was insufficient evidence to support convictions against a licensed pharmacist for various crimes, including, but not limited to, grand larceny in the first degree. See People v. Gross, Ind. 897-12, slip op. 00461 (N.Y. App. Div. Jan. 23, 2019).
The defendant pharmacist was convicted of various criminal charges because of his role in a criminal operation whereby an Alabama licensed wholesale drug distributor would illegally purchase from patients previously dispensed drugs used to treat AIDS and HIV.
