Bob Duffy Quoted in Law360 Article About December Appellate Argument Sessions Benefits Attorneys Should Watch
Bob Duffy, a Milwaukee-based Quarles & Brady Labor & Employment partner, was quoted in a Law360 article that discussed three upcoming appellate argument sessions that should be on benefits attorneys' radar. The first argument detailed the ‘Gender-Identity Mandate,’ the second argument discussed the ERISA bankruptcy dispute and the third explained how American Airlines pilots are appealing due to being denied pay for absences because of military service, which Duffy addressed.

"It's generally news to employers that USERRA may require them to grant paid military leave, if they offer paid leave for other sort of analogous types of leaves," Duffy said, such as paid leave for jury duty, bereavement or sick leave.
Duffy pointed out how the Third Circuit appeal had reached a panel argument months after FedEx agreed in March to pay $1.5 million in Delaware district court to end a similar military leave discrimination suit from its employees.
"They never got a final decision from a court of appeals, but apparently decided they'd rather pay it than fight it," Duffy said. "And that, to me, is indicative of the fact that you've got a number of employers now that are concerned about this," Duffy said.
