Andre Fiebig, a partner in the business law practice at Quarles & Brady LLP predicted that new thinking may come, if not from the regulators then from the courts. He said the FTC made a legal argument that is hard to defend by declaring in 2013 that Amazon was presenting sufficient competition in the office supply space to allow Office Depot to buy OfficeMax but two years later Amazon's market presence was insufficient to let Staples acquire Office Depot. "My gut feeling is that a fundamental issue for the court to decide is whether if you consider Amazon a competitor to Office Depot, then Amazon must be a competitor to everyone."
