A host of ethical issues routinely arise in insurance coverage disputes. If they are not expressly addressed in a timely manner, these issues may prevent policyholders from maximizing their insurance recovery and prejudice the defense of claims against the policyholder. The focus of this presentation will be on simple questions, the answers to which are sometimes surprisingly complicated when there are disputes regarding the existence and scope of insurance coverage for an underlying claim, including, but not limited to:
- Who is the client?
- Which conflicts trigger the right to independent counsel?
- Does the insured get to select its independent counsel?
- Does a privilege apply to communications shared with the insurer?
- What communications can the insured withhold from its insurer on privilege grounds?
